Regululatory Alerts Item – Pesticide General Permits under the National Pollutant Discharge Elimination System (NPDES) System

On June 4, 2010, the Environmental Protection Agency (EPA) published a notice of draft permit and notice of public hearings regarding Pesticide General Permits (PGP) under the National Pollutant Discharge Elimination System (NPDES) System. The PGP regulates discharges to waters of the U.S. from the application of biological pesticides, chemical pesticides that leave residue, and the following pesticide use patterns: flying insect pest control, aquatic weed and algae control, aquatic nuisance animal control, and forest canopy pest control. When the rule takes effect on April 10, 2011, any operator with a point source discharge resulting from the application of pesticides will be in violation of the Clean Water Act if those discharges are not covered under an NPDES permit. Comments must be received by July 19, 2010.
